Workers’ compensation.
Start with your people.
Understand the employment arrangements, work activities and state requirements that belong in your insurance discussion.
What is workers’ compensation?
Workers’ compensation addresses covered work-related injuries and illnesses through a statutory system. Benefits and employer obligations depend on applicable law and the circumstances.
A New York consideration
New York generally requires employers with employees to maintain workers’ compensation coverage, subject to specific rules and exceptions. Part-time work, ownership structures, family members, subcontractors and work performed across state lines can make the analysis more detailed.
Do not assume that describing a worker as an independent contractor settles the insurance requirement. Confirm the applicable rules with the New York State Workers’ Compensation Board and qualified professionals.
Questions to prepare
- Who works for the business, and what work do they perform?
- In which states is the work performed?
- How are payroll and work classifications recorded?
- Are there subcontractors, leased employees or owner/officer questions?
- What audit, reporting and policy renewal requirements apply?
